Even after a DUI suspension, you may be eligible for a restricted license that allows you to drive to and from work, school, or DUI programs. Learn about the eligibility requirements, application process, and conditions you must meet to obtain restricted driving privileges.
Two Types of Restricted Licenses
California offers two primary types of restricted licenses after a DUI-related suspension. The IID-restricted license allows you to drive any vehicle equipped with an ignition interlock device with no restrictions on when or where you can drive, as long as the IID is installed and maintained. The employment-restricted license (also called a "to/from" restricted license) limits driving to specific purposes including to and from work, to and from DUI education programs, and for other essential needs. The employment-restricted license does not require an IID installation.
Eligibility Requirements
For a first-offense DUI, you are generally eligible for a restricted license after serving a 30-day hard suspension. You must be 21 or older, have a valid California driver's license that is not expired, have enrolled in a licensed California DUI education program, and file an SR-22 certificate of financial responsibility with the DMV. For a second offense within 10 years, you must serve a 90-day hard suspension before IID-restricted eligibility. For a third offense, you must serve a 6-month hard suspension.
Under California's current IID program, first-offense DUI drivers can obtain an IID-restricted license immediately without serving any hard suspension, provided they install the IID and file SR-22. This allows you to continue driving without interruption — a significant advantage over the employment-restricted license.
Application Process and Requirements
To apply for a restricted license you must enroll in a licensed California DUI education program and obtain proof of enrollment, file an SR-22 certificate with the DMV from your insurance provider, pay the DMV restriction fee of $125 plus any reinstatement fees, and if applying for an IID-restricted license, provide proof of IID installation from a DMV-approved provider. Submit all documentation to the DMV and wait for processing. The DMV typically processes restricted license applications within 2 to 4 weeks.
